1. Acceptance of Terms
Welcome to Smart Passes Wallet ("App," "we," "our," or "us"). By downloading, installing, or using our mobile application, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.
These Terms constitute a legally binding agreement between you and Smart Passes regarding your use of the App.
2. Description of Service
Smart Passes Wallet is a mobile application that allows users to:
- Store and organize digital passes, loyalty cards, coupons, tickets, and memberships
- View pass information including barcodes and QR codes
- Receive notifications about pass updates (when enabled)
- Manage their digital wallet locally on their device
The App functions entirely on your device and does not require an internet connection for basic functionality.
3. User Responsibilities
By using the App, you agree to:
- Use the App only for lawful purposes and in accordance with these Terms
- Not use the App to store or display fraudulent, counterfeit, or unauthorized passes
- Be responsible for maintaining the security of your device
- Not attempt to reverse engineer, decompile, or disassemble the App
- Not use the App to infringe upon the rights of others
- Ensure that any passes you add to the App are legitimately obtained
4. Intellectual Property
The App and its original content, features, and functionality are owned by Smart Passes and are protected by international copyright, trademark, and other intellectual property laws.
You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms.
5. Pass Content and Third-Party Materials
The passes, cards, and tickets you store in the App are provided by third-party merchants, businesses, or organizations. We are not responsible for:
- The validity, accuracy, or authenticity of any pass content
- The terms, conditions, or policies of pass issuers
- Any disputes between you and pass issuers
- Changes or updates made by pass issuers to their passes
Any issues with specific passes should be directed to the merchant or organization that issued the pass.
6. Privacy
Your privacy is important to us. Our use of your information (or lack thereof) is governed by our Privacy Policy.

- We do not collect any personal data
- All pass data is stored locally on your device
- We do not share any information with third parties
7. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- IMPLIED WARRANTIES OF MERCHANTABILITY
- FITNESS FOR A PARTICULAR PURPOSE
- NON-INFRINGEMENT
- ACCURACY OR RELIABILITY OF ANY CONTENT
We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SMART PASSES, ITS DIRECTORS, EMPLOYEES, PARTNERS, OR AFFILIATES BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or business opportunities
- Any damages arising from your use or inability to use the App
- Any damages arising from unauthorized access to your device
This limitation applies regardless of the legal theory on which such liability is based.
9. Indemnification
You agree to defend, indemnify, and hold harmless Smart Passes and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:
- Your use of the App
- Your violation of these Terms
- Your violation of any third-party rights
- Any passes or content you add to the App
10. Modifications to the App
We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of the App.
11. Changes to Terms
We may update these Terms from time to time. Any changes will be posted with an updated "Last Updated" date. Your continued use of the App after any changes constitutes your acceptance of the new Terms.
We encourage you to review these Terms periodically.
12. Termination
You may stop using the App at any time by uninstalling it from your device. We may terminate or suspend your access to the App immediately, without prior notice, for any reason, including if you breach these Terms.
Upon termination, all data stored in the App on your device will be deleted when you uninstall the App.
13. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the App shall be resolved through appropriate legal channels.
14. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
15. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Smart Passes regarding the use of the App and supersede any prior agreements.
